Track Owners Gain Scheduling Flexibility

Starting May 28, 2026, railroad track owners are no longer required to follow the specific Federal scheduling process in 49 CFR 237.71(e) that mandated an initial load-capacity determination within five years of a bridge management program adoption date. The rule removes that transitional scheduling requirement and gives track owners more freedom to schedule bridge load evaluations, and the FRA says this change cuts red tape without adding costs or delays.

Must Still Determine Bridge Load Capacity

Even after May 28, 2026, each track owner must still determine the load capacity of each railroad bridge and document those determinations in the track owner's Bridge Management Program using appropriate engineering methods and standards. The final rule removes only the obsolete scheduling paragraph; all other bridge load capacity requirements in 49 CFR part 237 remain unchanged.

No New Paperwork or Small-Entity Costs

FRA certified that this final rule will not have a significant economic impact on a substantial number of small entities and contains no new information collection requirements. OMB approved the existing recordkeeping and reporting requirements in part 237 on April 1, 2026 (OMB control number 2130-0586), with approval expiring April 30, 2029.
