Indiana Takes Over Radiological Oversight

The NRC would discontinue its authority over 213 licenses and transfer regulatory authority for certain byproduct, source, and small-quantity special nuclear materials to the State of Indiana. Governor Mike Braun requested the Agreement by letter dated January 29, 2026, and the final effective date will be published after Commission approval.

Federal NRC Keeps High‑Hazard Authority

The Agreement explicitly retains NRC authority over construction, operation, and decommissioning of production or utilization facilities and uranium enrichment facilities; byproduct material defined in Section 11e.(2) of the Act; export/import of covered materials; certain disposal authorities (including ocean disposal); evaluation and registration of sealed sources or devices; and land disposal of material received from others. Those activities will remain under federal regulation rather than transfer to Indiana.

Indiana Will Match or Exceed NRC Inspections

Indiana's Radioactive Materials Control Program adopted an inspection schedule that is 'as frequently as, or more frequently than,' the inspection schedule used by the NRC for covered licensees. The State has procedures for inspections, reporting findings, and enforcement.

Existing NRC Licenses Remain Valid

After the Agreement's effective date, licenses issued by the NRC for materials covered by the Agreement will continue in effect as State of Indiana licenses until they expire or are replaced by State-issued licenses. Licenses for which a renewal application was filed more than 30 days before expiration will continue in a 'timely renewal' status through the transition.

Reciprocal Recognition of Licenses Planned

The Commission and the State of Indiana agree to develop rules and procedures to provide reciprocal recognition of licenses for the materials listed in Article I. The Agreement commits both parties to pursue reciprocity so state-issued and other Agreement State licenses can be recognized as appropriate.
