Sensitive Personal Data Collected
OSHRC-10 will include grievance and ADR records that can contain names, employment titles, signatures, addresses, telephone numbers, witness statements, facts about alleged grievances, and personal information such as birthdate, sex, and race. Medical and genetic information, if present, will be handled consistent with the Rehabilitation Act and the Genetic Information Nondiscrimination Act (GINA).
Routine Disclosure to Government Entities
OSHRC-10 permits routine disclosures of records to entities such as the Department of Justice, courts, federal/state/local investigative agencies, OPM, OMB, Members of Congress, NARA, and other Federal entities for litigation, investigations, oversight, and breach response. Disclosures of medical/genetic information will be withheld or redacted to comply with applicable rules.
Access and Contesting Rights
If you are the subject of a record in OSHRC-10, you may request access, notification, and contest the content of your records by contacting the OSHRC Privacy Officer at 1120 20th Street NW, Ninth Floor, Washington, DC 20036-3457, and following procedures in 29 CFR 2400.4, 2400.6, and 2400.7.
New OSHRC Records System Established
You are affected if you are a current or former OSHRC employee or an OSHRC contractor who filed an administrative grievance under 5 CFR part 771 or requested participation in the agency's Alternative Dispute Resolution (ADR) Program. OSHRC published a new Privacy Act system of records titled Administrative Grievance and Alternative Dispute Resolution Records (OSHRC-10) that will begin on June 17, 2026.
Physical and Electronic Safeguards
OSHRC will store paper records in locked file cabinets at its National Office and electronic records on a shared OSHRC drive for which access is restricted to the system manager. Access to records is limited to personnel who require it to perform official functions.
Retention and Disposal Under NARA Schedules
Administrative grievance records and ADR records in OSHRC-10 will be retained and disposed of in accordance with the National Archives and Records Administration General Records Schedule (GRS) 2.3, Item 60 and Item 70, respectively.
