Summary
Nationwide ban on expanded polystyrene (EPS) foodware, loose fill, and coolers. This bill would bar sales and distribution of single-use EPS food containers, packing peanuts, and most EPS coolers starting January 1, 2028 and set enforcement rules and penalties to drive the transition away from EPS.

- Consumers: People would no longer be able to buy or receive EPS single-use food containers or most EPS coolers after January 1, 2028.
- Businesses: Manufacturers, distributors, and retailers would have to stop selling EPS foodware, loose fill, and coolers by that date and face escalating civil penalties for repeat violations: $250 for a second violation, $500 for a third, and $1,000 for fourth and subsequent violations.
- Small businesses: Penalty limits protect smaller firms by capping repeat penalties so food service providers and retailers with under $1 million in annual revenue and manufacturers/distributors with under $5 million are not penalized more than once in a 7-day period.
- Government role: The Environmental Protection Agency Administrator could write regulations to implement the ban and allow qualifying states to enforce it locally.

Nationwide ban on foam containers and packing peanuts
Starting January 1, 2028, this bill would ban selling or distributing foam food containers, foam coolers, and packing peanuts. Importers would count as manufacturers, so the ban would cover imports too. Foam coolers for drugs, medical devices, or biological products would still be allowed. Stores and restaurants would need to switch to other products, which could change what you see and what some items cost.
Foam ban warnings, fines, and state enforcement
If enacted, the Administrator would have to give written notice after a violation before higher fines can apply. After notice, fines would be $250 for a second violation, $500 for a third, and $1,000 for a fourth or later, per violation, starting January 1, 2028. Small entities would get a limit on how often they can be fined: food sellers or retailers under $1,000,000 in yearly revenue, and manufacturers or distributors under $5,000,000, could be fined at most once in any 7‑day period. The Administrator could also let States enforce the ban if they meet rules the Administrator sets.
