Five-year bar on gun sales after violent misdemeanors

If enacted, it would bar selling or giving a gun or ammo to anyone convicted of a violent misdemeanor in the last 5 years. A violent misdemeanor would mean a misdemeanor under federal, state, tribal, or local law that involves force, a weapon, or causing or intending physical injury. A conviction would count only if you had a lawyer or knowingly waived one, and if a jury trial was available, you had a jury or knowingly waived it. Expunged, set-aside, pardoned, or rights-restored cases would not count unless the order says you still cannot have guns. This would apply only to convictions that happen starting 6 months after enactment, and background checks would reflect the new rule.
