Summary

Caps Social Security recoveries for non-fraud overpayments at 10 percent of a beneficiary's monthly benefit. This bill would stop the Social Security Administration from reducing a monthly Social Security (Title II) benefit by more than 10 percent to recoup an overpayment that the Commissioner does not believe resulted from fraud unless the recipient asks for a higher recovery rate.

Social Security overpayment withholding capped at 10%

If enacted, the Social Security Administration would be limited to withholding no more than 10% of your monthly Social Security benefit to repay a non‑fraud overpayment. The 10% cap would not apply if the agency has reason to believe fraud or similar fault occurred. You could ask the agency to withhold more than 10% if you want faster recovery. The change would take effect on the date of enactment and would apply to overpayments that are outstanding on or after that date.
