Bans paid conversion therapy as a deceptive and harmful practice. This bill would define conversion therapy and make it unlawful to provide, advertise, or facilitate compensated efforts to change a person’s sexual orientation or gender identity, while carving out supportive and gender-affirming care.

Ban on paid conversion therapy and ads

This bill would ban paid conversion therapy. It would also ban ads that claim it can change orientation or gender identity, or that it is harmless. Paid help that assists others to provide it would also be illegal. The ban would apply when a provider is paid for the treatment, or for an integral product or service, unless that product is protected by the First Amendment. It would not cover support, acceptance, identity exploration, neutral safety counseling, or care that helps with a gender transition; effective upon enactment.

FTC and states would enforce ban

Violations would be treated as unfair or deceptive practices by the Federal Trade Commission. The FTC could make rules and bring cases, and the U.S. Attorney General could sue in federal court. State attorneys general (and other authorized state officers) could sue for their residents, usually after notifying the FTC. The FTC could join state cases, and an FTC case would pause new state cases against the same defendant for that violation. State investigatory powers and separate state‑law actions would still be allowed, and the rules would take effect upon enactment.
