Sponsored By: Representative Rep. Vargas, Juan [D-CA-52]
In Committee
Summary
Restores DACA (Deferred Action for Childhood Arrivals) recipients' access to federal single-family housing programs. Show full summary
- Families and households: DACA recipients would be able to use federally backed single-family mortgage insurance and guarantees and be eligible for housing assistance programs that refer to the Housing and Community Development Act of 1980. This opens access to FHA, Rural Housing Service, and certain HUD-assisted programs for those defined by the stated DHS memo.
- Housing market actors: The bill would bar FHA, the Rural Housing Service, Fannie Mae, and Freddie Mac from conditioning mortgage insurance, guarantees, or purchases on a borrower's DACA status.
- Veterans: The law would make clear that VA home loan entitlement does not depend on whether a veteran is a DACA recipient.

Mortgages open to DACA borrowers
If enacted, federal mortgage programs would be barred from denying single-family loans because you are a DACA recipient. This would cover FHA, the Rural Housing Service, Fannie Mae, and Freddie Mac. Agencies also would not be allowed to issue a limited denial of participation based on DACA status. You would still need to meet all other loan rules. A DACA recipient means someone who, on the date of enactment, has deferred action under the June 15, 2012 DHS memo.
Housing aid for DACA recipients
If enacted, DACA recipients would be treated as eligible for a housing assistance category under current law. You could apply for assistance that follows section 214(a) rules, starting upon enactment. Actual help would depend on each program’s rules and funding. A DACA recipient means someone who, on the date of enactment, has deferred action under the June 15, 2012 DHS memo.
VA home loans not tied to DACA
If enacted, a qualifying veteran’s DACA status would not affect their VA home loan entitlement. VA could not deny or reduce benefits because the veteran is a DACA recipient. A DACA recipient means someone who, on the date of enactment, has deferred action under the June 15, 2012 DHS memo. This would start upon enactment.
