- Individuals and patients: Would get wide rights to access, correct, and delete their reproductive or sexual health information, including inferred data and records of third-party disclosures, in both human-readable and machine-readable formats.
- Businesses and service providers: Would have to minimize collection, restrict employee and vendor access to only what is strictly necessary, publish a clear privacy policy, and follow new retention, disclosure, and governance rules.
- Enforcement and legal remedies: Would let the Federal Trade Commission write rules and enforce violations as unfair or deceptive acts, and would allow private suits with remedies of at least $100 up to $1,000 per violation per day, plus punitive damages and attorney fees.
- Federal-state balance and speech: Would preserve other federal privacy laws, allow states to provide stronger protections, and clarifies it does not limit First Amendment rights.

You could sue and skip arbitration
If enacted, you could sue a company that violates this law. A court could award at least $100 and up to $1,000 per violation per day, or your actual damages if higher. Courts could also award punitive damages and attorney’s fees. Pre‑dispute arbitration and class‑waiver clauses would not apply to these cases. A court would decide if the ban applies. The bill says a violation would count as a concrete injury so you can bring a case.
Stronger control of your health data
If enacted, covered companies could only collect or use your reproductive or sexual health data when it is strictly needed to provide the service you asked for. They would have to limit which workers can see your data. You would be able to request access, corrections, or deletion through an easy tool, including online. They would have to give you a readable and machine‑readable copy within 15 days, at no charge. They would also have to post a clear privacy policy that explains what they collect, why, who they share it with, and your controls.
FTC enforcement and stronger state laws
If enacted, the FTC could enforce this law like other consumer protection rules and issue regulations. Companies could share data with the FTC when required by law or court order. State privacy laws that give stronger protections would still apply. A state law would be preempted only if it actually conflicts with this bill.
What data and companies are covered
If enacted, the law would cover many kinds of reproductive and sexual health data, including pregnancy status, period tracking, contraception, abortion care, related location data, and data inferred from other information. It would apply to many companies, including some nonprofits and phone carriers, but not to providers acting under HIPAA or entities covered by 42 U.S.C. 290dd‑2 in that role. This means some health providers stay under other privacy laws, while apps and other firms could be covered here.
No retaliation for using your rights
If enacted, companies could not punish you for using these data rights. They could not deny service, change prices, give worse quality, or suggest you will be penalized.
