HR5228119th CongressWALLET

HCBS Worker Protection Act of 2025

Sponsored By: Representative Dingell

Introduced

Summary

Removes a statutory payment cap on certain Medicaid home- and community-based services waivers. The bill would amend Title XIX of the Social Security Act by striking subparagraph (C) of section 1915(c)(11) (42 U.S.C. 1396n(c)(11)). Its effect is to eliminate that specified limitation on payments for those HCBS waivers. The text provided does not include the content of the removed subparagraph and does not add any new funding, eligibility, enforcement, or sunset provisions.

Possible higher Medicaid home care pay

If enacted, this would remove a federal cap on what states can pay for Medicaid home and community-based care. States could choose to raise provider rates or increase support for people using these services. It would not change who qualifies. The bill does not state how much more money this could be or a start date.
