Protecting HUD and public housing records from immigration enforcement. This bill would bar the Department of Housing and Urban Development (HUD) and public housing agencies (PHAs) from disclosing system-of-records information for immigration enforcement unless an individual makes a written request in a language they can use or gives prior written consent. The prohibition applies regardless of an individual's immigration status.

  • Families and tenants: Immigrant and mixed-status households would have HUD and PHA records kept from immigration-related requests unless the person requests release or consents in writing in a language of proficiency.
  • Public housing agencies (PHAs): PHAs could not be compelled by the HUD Secretary to disclose covered records and must secure the systems of records described by the bill.
  • HUD and the Secretary: The bill would require the Secretary to submit to Congress within 90 days a report with a compliance timeline, confirmation that records are secured, a description of prior record sharing, and a plan to ensure compliance.
  • Immigration enforcement and other agencies: Federal immigration enforcement and any other person would be barred from obtaining HUD or PHA records for immigration enforcement unless the bill's written-request and language rules are met.

Stops HUD from sharing records for immigration

HUD would be barred from sharing housing records for immigration enforcement, even if other laws usually allow it. This would apply no matter your immigration status. Records could be shared only if you give written consent in a language you understand. HUD would also be unable to force local public housing agencies to hand over these records. Within 90 days of enactment, HUD would report to Congress on securing records and how it would comply.
