This bill would limit how much consumers could recover in Fair Credit Reporting Act cases. In individual cases, awards would be capped at the lower of $100,000 or 40% of the damages the court awards. In willful-violation class actions, courts could not set a per‑member minimum, and the class’s total recovery (not counting attorney fees) would be capped at the lesser of $500,000 or 1% of the defendant’s net worth. In negligent class actions, consumers could get actual damages only, and the class’s total recovery (not counting attorney fees) would be capped at the lesser of $500,000, 1% of net worth, or in some cases the case’s costs and court‑approved fees. In both types of class cases, costs and attorney fees would be limited to the lower of $100,000 or 40% of damages.
