Summary
Treat drilling fluids, produced waters, and other wastes from oil, gas, and geothermal production as hazardous waste when they meet the law's criteria. This bill would require EPA to decide which of those wastes meet hazardous-waste criteria and to write rules controlling them and tightening standards for facilities that receive non-listed wastes.

Would tighten EPA rules on drilling waste
If enacted, the EPA would have 1 year to decide if drilling fluids, produced water, and other oil, gas, and geothermal wastes are hazardous. If they meet the test, the EPA would list them and set handling and disposal rules under Subtitle C, tailored as needed while protecting health and the environment. For wastes not listed as hazardous, the EPA would, within 1 year, update rules for sites that take them. Those updates would require groundwater monitoring, limits on where facilities can be located, cleanup plans, and financial assurance.
