To prohibit funds made available to the Department of Health and Human Services by previous Appropriations Acts from being used for any activity that makes Medicare Advantage the default under the Medicare program.
Sponsored By: Representative Pocan
Introduced
Summary
Prevents Medicare Advantage default enrollment. The bill would bar funds available to the Department of Health and Human Services from being used to treat someone with Medicare Part A and Part B as having elected a Medicare Advantage plan unless that person explicitly elects MA under the statute in section 1851(e)(1). The text preserves the narrow exception in subsection 1851(c)(3).

Stop automatic Medicare Advantage enrollment
This bill would bar HHS from using certain previously approved funds this fiscal year to make Medicare Advantage the default. If you have Medicare Part A and Part B, you would only be put in an MA plan if you choose it. The bill would keep the narrow exception already in Medicare law. It would apply even if other rules say otherwise.
