Choose court over arbitration for race claims

If enacted, people alleging race discrimination could choose court instead of arbitration. Predispute arbitration clauses and class or collective action waivers would not be enforceable for these cases under federal, tribal, state, or local law. A court, not an arbitrator, would decide if this law applies, even if the contract says otherwise. Covered disputes would include discrimination, harassment, or retaliation based on race, color, or national origin. These rules would apply only to disputes that arise on or after the date the bill becomes law.
