More release rights for immigrants

If enacted, this bill would make release the default for people in DHS custody and limit detention. The Secretary would have to offer community-based case management outside ICE that gives housing, medical, legal help, and transportation. The program could not use ankle monitors and participants would not be charged fees. You would get a written custody decision within 48 hours and a hearing to challenge custody within 72 hours. A full new custody hearing would be held within 30 days and then every 60 days; judges would start with a presumption of release and must consider your ability to pay bond and not keep you detained only because you cannot pay. The bill would require private, confidential access to your lawyer, a legal orientation before your first judge hearing, prompt probable-cause hearings within 48 hours, and DHS transport to required court appearances plus indoor visitor waiting areas. It would also let a detained person sue in federal court if detention standards are violated and get injunctive relief, money damages, and attorney fees.

Detention oversight and penalties

If enacted, this bill would require DHS to set national detention standards within 1 year and update them at least every 2 years. The Inspector General would do unannounced, in-person inspections at least once a year and post reports within 60 days. DHS would post a monthly Facilities Matrix with detailed data and treat inspection and contract records as public FOIA records. For serious violations the bill would require enforcement: a first qualifying private-facility failure would trigger a fine of not less than 10% of the contract value and DHS facilities would get a written warning and short fix period; repeated failures within 2 years would force transfers and contract termination (private) or suspension until fixed (DHS). The bill would phase out for-profit detention contracts within 3 years and require a public implementation plan within 60 days. For any death in DHS custody, Congress must be notified within 24 hours, an investigation must start within 30 days with a root-cause analysis, a public report must issue within 60 days, and the IG must review it within 90 days.
