Bigger OSHA fines and stricter records
This bill would raise OSHA fine limits a lot. Some caps would rise to $800,000, and others to $80,000 or $40,000, depending on the violation. Failing to keep required safety records would count as a continuing violation until fixed or until the record rule expires. The Labor Department would have to issue recordkeeping rules within one year of enactment. Higher OSHA fines would start January 1, 2027; the recordkeeping changes and rulemaking timeline would begin on enactment.
Higher fines for wage and union abuses
This bill would raise fines for several worker-protection laws. Child labor penalties would be $1,500–$150,000 per child, or $7,000–$700,000 if a minor is killed or seriously hurt, with doubling for repeats. Wage and hour fines could reach $25,000 per violation, or $50,000 if repeated or willful, and there would be a new $2,500 penalty for record violations. Interfering with family and medical leave could bring up to $25,000 per offense, and failing FMLA notice or record rules could cost up to $2,500 each. Breaking union rights rules could cost up to $50,000 per violation, doubled to $100,000 for a repeat within five years, and farmworker protection fines would rise to $30,000. Most of these changes would apply starting January 1, 2027.
Stronger mental health parity enforcement
This bill would let the government hold more health plan actors accountable for mental health parity and genetic information rules. Plan administrators, service providers, and insurers could face penalties, not just plan sponsors. This could help workers and families get equal coverage for mental health and substance use care. These changes would start January 1, 2027.
When these changes would start
Most higher penalties and enforcement tools would begin January 1, 2027, and apply only to violations on or after that date. Recordkeeping and MSHA payment‑collection changes would apply on enactment. For older unpaid MSHA penalties, the bill would treat the final‑order date as the date of enactment for these collection rules.
Tougher mine safety and payment enforcement
This bill would raise penalties for retaliating against miners: $10,000–$100,000 for a first offense and $20,000–$200,000 for repeats in a 3‑year period. If a mine has a written pattern notice, violations during that period could be penalized at up to twice the normal amount, capped at the legal maximum. If a final penalty is unpaid 45 days after it becomes final, MSHA would send a delinquency letter; at 180 days, MSHA would order most workers out of the mine until the debt is paid or compliance is achieved. Black Lung penalties would rise to between $5,000 and $50,000. Most penalty increases would start January 1, 2027, while the delinquent‑payment and withdrawal order process would apply on enactment with a special rule for older unpaid orders.
