Study of LGBTQ Military Discrimination

This bill would direct the Commission to study how people were policed for sexual orientation and gender identity in U.S. uniformed services since World War II. The Commission would collect records, discharge and reentry codes, DEERS and VA data (including changes made without consent), and hold public hearings with named or anonymous testimony. It would examine denied care including gender-affirming treatment, mental health harms, suicidality, homelessness, career and financial harms, effects on dependents, and costs to readiness. The Commission could subpoena documents, request agency cooperation, and recommend remedies like apologies, back pay, reinstatement, restored VA and gender-affirming care, streamlined record corrections, and review of burial rights.

Creates Military Equity Commission

This bill would create a 15-member Commission on Equity and Reconciliation in the Uniformed Services. Appointments would be made within 30 days of enactment and the President would call the first meeting within 30 days after enactment or after appropriations are available. Members could be paid at a daily rate up to the Executive Schedule level IV equivalent and the Commission could hire staff and experts with pay capped at the Executive Schedule level V equivalent. The Commission would be able to contract, get administrative support from GSA, receive such sums as Congress provides, deliver a final report to Congress within one year of its first meeting, and end 90 days after filing that report.
