  • Railroads and operators: The bill would require visual inspections on main line track designated for Class 3 speeds or higher at least twice per week with at least one calendar day between inspections. Any defect found by any inspection, detection, or monitoring method would have to be corrected, protected, or removed from service immediately.
  • Qualified inspectors: A person designated as a qualified inspector under current rules would have to initiate remedial action immediately when they find a deviation from Part 213. That inspector would have sole authority to permit any movements needed to repair track taken out of service.
  • Automated inspection and federal rules: Within one year the bill would require updates to Subparts F and G of Part 213 to set Track Geometry Measurement System (TGMS) coverage and inspection frequencies by track Class. It would anchor those updates to the Code of Federal Regulations as of January 1, 2026 and prevent waivers when alternative methods fail to detect defect types the Federal Railroad Administration recognizes as unsafe.

Ban on safety-rule waivers

If enacted, the Secretary of Transportation would not be allowed to grant waivers, exemptions, or modifications to safety rules if a proposed alternative inspection or monitoring method would fail to detect all defect conditions the FRA recognizes as unsafe under rules in effect on January 1, 2026. This ban would apply even if another law might otherwise allow a waiver. It would take effect upon enactment.

Immediate track fixes and inspector authority

If enacted, any defect found by inspections, sensors, or machines would have to be corrected, protected, or removed from service immediately under the rules in effect on January 1, 2026. A qualified inspector who finds a deviation would have to begin remedial action right away and would have sole authority to allow any train movements needed to fix out-of-service track. The Secretary would have to update part 213 within one year after enactment so machine findings are covered by the same immediate-remediation rule.

New automated track inspection schedules

If enacted, the Secretary would have to update Subparts F and G of part 213 within one year to set minimum Track Geometry Measurement System inspection schedules and rules. For example, Classes 1–5 with cant deficiency over 5 inches would be checked at least four times per year with at least 43 days between checks. Class 9 track would be inspected at least twice during any 30-day period with at least six days between checks. Crossovers where track speed exceeds 30 mph would be inspected at least twice per year with at least 120 days between inspections.

Twice-weekly inspections for main line tracks

If enacted, main line tracks designated for Class 3 speeds or higher would need visual inspections by a qualified inspector at least twice each week. Inspections must have at least one calendar day between them. This requirement would take effect upon enactment.
