Rename Medicare Advantage plans
If enacted, this bill would rename the Medicare Advantage program to "Alternative Private Health Plan" (APHP). The Department of Health and Human Services would have to change labels and materials. HHS must finish the transition for plan years beginning on or after October 15, 2023. The change would not alter who qualifies, plan benefits, or payment rules for Part C.
Fines for using “Medicare” in titles
If enacted, the bill would add a $100,000 civil penalty for each time an entity uses the word "Medicare" in the title of a Part C plan. The rule would apply to advertising of Part C plans on or after the date of enactment. Subsections (c), (g), and (h) of section 1128A would apply to these penalties in the same way they apply to other civil money penalties.
