  • Hospitals and skilled nursing facilities owned or controlled by covered firms would be ineligible for Medicare payments. Facilities owned by a covered firm on the date of enactment would have a 3-year delay before the prohibition applies.

Medicare ban on private equity facilities

If enacted, the bill would bar Medicare payments to any hospital or skilled nursing facility owned or controlled by a private equity fund, a corporation run by private equity, or a REIT. Facilities owned or controlled by such firms on the date the law passes would keep Medicare payments for three years. The bill would define "control" to include directing management or owning 10% or more of voting shares. Facilities found in violation would get notice and a chance for an administrative hearing under current law. The owner firm or affiliate could be held jointly and fully responsible for penalties or obligations the facility owes.
