  • States: Would need to submit an initial dataset within 180 days after enactment covering the five most recently concluded fiscal years. The initial submission must include six data elements, such as number of open investigations, total fraud cases and dollar amounts, enforcement actions, and recoveries.
  • USDA/Secretary of Agriculture: Would collect and enforce the data rules, prepare an initial congressional report within 180 days after receiving all required data, and publish reports online. Annual state submissions would be due within 60 days after October 1, 2028 and after each October 1 thereafter, with corresponding published reports due within 180 days.
  • Congress and the public: Would receive regular, published reports that disclose trends in SNAP fraud and enforcement, increasing transparency about fraud cases and recoveries.

New SNAP fraud data and penalties

This bill would require each State to send detailed SNAP fraud data to the Secretary of Agriculture. States would send an initial file within 180 days after enactment covering the five most recently concluded fiscal years and six specific items: open investigations; total fraud cases and dollar amounts (including card skimming/cloning); enforcement actions taken; recoveries; disqualifications involving deceased identities; and disqualifications involving missing or fake Social Security numbers (the last two for fiscal years beginning after enactment). After that, States would send the same data each year (first annual deadline: 60 days after October 1, 2028). If a State missed a deadline, the Secretary would withhold SNAP administrative funds from that State until the required data were received.
