Summary
Bans deceptive advertising about reproductive health services. This bill would make it unlawful to misrepresent that you offer contraception, abortion, referrals, or access to licensed medical staff, and it would give the Federal Trade Commission authority to write rules and enforce the ban.

Ban and penalties for deceptive reproductive health ads
This bill would ban ads that lie about offering contraception or abortion, or referrals for those services. It would also ban ads that falsely claim to have licensed medical staff. The Federal Trade Commission (FTC) would enforce the ban nationwide, including for nonprofits. The FTC could sue in federal court for injunctions, penalties, refunds to people, and other relief. Each violation could bring a civil penalty up to the greater of $100,000 (adjusted yearly for inflation) or 50% of the violator’s ultimate parent revenue from the prior 12 months. The FTC would lead these cases and could act in its own name.
FTC rules and definitions for the ad ban
This bill would let the FTC write rules using the normal public notice process. It would define abortion services to include medical and non-medical services linked to an abortion, even on different days. It would adopt the standard federal meaning of “person.” It would not limit any other FTC powers. These steps would guide how the ad ban would work in practice.
