Use health accounts to pay for diapers

If enacted, medically necessary diapers and diapering supplies would be eligible for reimbursement from HSAs, Archer MSAs, FSAs, and HRAs. The change would apply to expenses paid after December 31, 2025. The bill defines medically necessary diapers (including age and provider diagnosis rules) and limits diapering supplies to items needed for proper cleaning and protection.

New federal diaper funding and rules

If enacted, the bill would add new federal diaper funding and rules. It would appropriate $200 million each year for FY2026–FY2029. The bill also sets the Social Services Block Grant baseline to $1.9 billion for FY2026–FY2029. The Secretary may reserve up to 2% each year for a national technical assistance group and up to $3 million in FY2026 for an evaluation. States would be limited to 5% for State administrative costs. The funding would be exempt from across-the-board sequestration after enactment.

Who can get diaper and incontinence help

If enacted, the program would let low-income families get diapers for children under age 4. 'Low-income' would be self-certified at 200% of the Federal poverty line. Children age 3 or older who are medically complex could get medically necessary diapers if a licensed provider diagnoses a chronic condition. Adults with disabilities and low-income adults could get adult incontinence supplies. Diaper help from this program would not count against other federal needs-based benefits. Disposable diapers under the program must meet quality and allergy rules.

Program evaluation and reporting rules

If enacted, HHS would have to issue implementation guidance within 180 days. HHS must complete an evaluation not later than 2 years after enactment and update it by year 3. The updated evaluation results must be reported to Congress and published, with another report within 120 days after the update. States must add detailed diaper distribution data to annual SSBG reports for FY2026–FY2029.
