Payback orders for harmed investors

The Commissioner of Securities can order a violator to return your money. The order covers the principal you paid and all money collected with your purchase. This applies when the person violated or helped violate Georgia securities rules in Code Sections 10-5-50, 10-5-51, or 10-5-54.

School roof grants and faster buying

Low-wealth school systems that meet state rules get capital outlay grants for roof work if the project is in their latest approved facilities plan and they use a supplier approved by a cooperative purchasing group and designated by the Department of Administrative Services. Roof improvements on existing buildings are no longer treated as public works construction. If a roof contract goes to an approved, designated supplier, it counts as meeting the competitive notice and award rules.

Faster, tougher securities enforcement

The law gives the state faster, stronger tools to stop securities violations. The Commissioner can issue cease-and-desist orders and limit or revoke exemptions for broker-dealers and investment advisers. Orders take effect the day they are issued and become final if no hearing is requested within 30 days. After a hearing, civil fines can reach up to $50,000 for one violation or up to $500,000 for multiple violations. Violators can be required to pay investigation costs, and courts can add $5,000 to $50,000 contempt fines per violation for ignoring an order. Courts cannot require the Commissioner to post a bond to enforce an order.
