Repeals new municipal pole enforcement section

The law repeals section 109-e of the General Municipal Law that the 2025 chapter added for municipal enforcement of pole-attachment safety and quality. This ends that specific local enforcement authority. The law takes effect on the same date and in the same manner as that 2025 chapter.

Public tool to report unsafe poles

The department may create a tool for people to report unsafe or improper pole attachments. Complaints must include the date and time, the location, and a short description. Include the pole owner, attacher, or contractor if known. The tool may also allow photos.

Pole owners and attachers must report annually

The law requires all utility pole owners and companies that attach equipment to file a yearly electronic report with the commission. Reports must show how many attachment requests came in, how long each took, and whether make-ready work was needed. For completed requests, reports must list poles sought, new attachments approved, the contractor, poles replaced and who paid, and the make-ready time and charges. The commission sets a uniform format, keeps the data in an electronic record, and may require other information.
