The Commission can hire private groups or universities under the Oklahoma Central Purchasing Act, and contractors must provide at least one draft before the final report. Each year starting in 2023, incentives scheduled for review are evaluated by October 1 in consultation with the Commerce Department’s research division. From October 1 to November 30, the Commission holds at least one public meeting for review and public comment. By December 15, it sends a report to the Governor, legislative leaders, and Secretary of State, and posts it online. Each evaluation estimates economic and fiscal impact, checks business behavior and statewide effects, reviews safeguards and administration, and recommends keeping, changing, or ending the incentive. The Commission sets criteria by rule (Administrative Procedures Act) in the Commerce code, and agencies must share needed data unless barred by law; evaluators must protect confidentiality.
People or businesses that get, or may seek, a state incentive cannot contact the Commission’s hired evaluator unless the evaluator asks for information. This does not stop them from speaking at public hearings.
