Para enmendar el inciso (b) de la Sección 3 y el inciso (a) de la Sección 4 de la Ley Núm. 95 de 29 de junio de 1963, según enmendada, conocida como "Ley de Beneficios de Salud para Empleados Públicos", para realizar emniendas técnicas, y añadir a los funcionarios y empleados del Departamento de Seguridad Pública y del Departamento de Educación en la definición de "empleado" con el fin de conformarla al estado de derecho vigente.

More health plan choices for Education staff

The Education Secretary, with recognized worker groups, can negotiate and sign private health plans. Department of Education employees and officials may choose to enroll in those plans. The Department can also accept plans the Administration already negotiated. These actions follow the contracting powers in Law 85-2018.

Who qualifies for public employee health plans

The law updates who counts as a public employee for health plans. It covers appointed or elected officials, active Executive Branch workers, and retirees of any branch, agency, department, or municipality. It also covers officials and employees serving outside Puerto Rico. Some employers are not covered by default: public corporations; Puerto Rico Police; University of Puerto Rico; the Judicial and Legislative branches; the Comptroller; CRIM; the Ombudsman; and the Departments of Public Safety, Education, and Housing and the Public Housing Administration. Those employers and their staff can join plans the Administration selects if the employer opts in and the employees are not in a bargaining unit, as allowed by this law.

Public Safety chief added to contracting powers

The law adds the Secretary of Public Safety to the officials covered by the Administration’s contracting authority. This clarifies who can take part in plan contracting. It does not by itself change who gets benefits or what people pay.
