Buyers can cancel or sue for missing flood info
Beginning September 1, 2025, if required flood information is not provided, the buyer can cancel. The buyer must cancel before title transfers or before moving in, whichever happens first. Buyers may sue to recover damages and reasonable lawyer fees. If the seller knowingly hid the info, buyers may seek punitive damages.
Buyers get key flood-risk details
Beginning September 1, 2025, buyers get key flood-risk details before the sale contract. Sellers must give a copy or link to the community’s FEMA flood map, or say no map exists. Sellers must say if the property flooded or had flood damage while they owned it, including erosion or landslide. Sellers must say if they have flood insurance, or if law requires it.
Seller protections for flood disclosures
Beginning September 1, 2025, sellers are not liable for disclosure mistakes based on a written report from an agency or licensed expert. The seller must have reasonably believed the report was correct and given it to the buyer. Not following these disclosure rules does not make the title unmarketable.
