Stronger 340B drug discounts and access

The law requires manufacturers to give 340B discounts at the time of purchase, not as later rebates. They cannot block or limit deliveries to contract pharmacies or stop them from dispensing to eligible patients. They also cannot demand extra claims or use data unless federal HHS requires it. Covered entities, contract pharmacies, or injured people can sue for damages and fees, and each package can count as a separate violation. These state rules do not change how Vermont Medicaid pays and must align with federal law.

New caps on hospital outpatient drug bills

Beginning January 1, 2026, hospitals cannot bill more than 120% of CMS’s Average Sales Price for drugs they priced above 120% on April 1, 2025. For drugs at 120% or less on April 1, 2025, hospitals cannot raise the percent above that level. Hospitals update the ASP reference on January 1 and July 1 using the most recent quarter. Hospitals cannot raise other drug or service prices to make up the difference. Independent critical access hospitals that are not affiliated are exempt. If the Care Board finds harm to access, quality, or rural care, a hospital can ask for narrow commercial rate increases, and the caps stay unless the Board sets a different reference price.

Hospital 340B reports and vendor privacy

Hospitals in the 340B program must file a yearly report by January 31 for the prior hospital fiscal year. Reports show drug purchase costs, payments, what was paid to contract pharmacies and vendors, how revenue helped the community, and compliance steps. Vendor names and details are confidential, but go to the Office of the Health Care Advocate, which cannot share them. The first report is due by January 31, 2026. The reporting rule ends on January 1, 2031.
