New Health Care Advocate helps Vermonters
Beginning July 1, 2025, the law creates the Office of the Health Care Advocate, which AHS maintains by contract with a nonprofit. You can get free help to pick plans, fix denials, and file appeals. With your written consent, insurers and providers must share your records with the Office. State agencies must share information and include the Office in policy work when the law allows. Staff must avoid conflicts, and the Office sends a yearly report by January 15.
Advocate joins hospital and nursing home reviews
Beginning July 1, 2025, the Health Care Advocate can file to intervene in certificate-of-need reviews. For nursing homes, the Long-Term Care Ombudsman can also intervene. Once they file, they get needed records, can ask questions, send comments, and testify at hearings. They cannot further disclose confidential or proprietary information they receive in these reviews.
More transparency in insurance rate reviews
Beginning July 1, 2025, the Green Mountain Care Board must post insurer rate filings and solvency and actuary analyses within 60 days. The Health Care Advocate has 30 days to send questions and written comments on a rate request. The Board must post those comments and consider them. After redacting confidential parts, the Board must post all questions and answers and the materials in the rate review record.
