Less CON review for non-hospital care
Non-hospital capital projects need a CON only if they cost over $10 million. One piece of diagnostic or therapeutic equipment needs a CON only if it costs over $5 million. A new service needs a CON only if yearly costs top $3 million in either of the next two budget years, and it was not offered in the past three years. The law removes CON review for ambulatory surgical centers and for hospitals starting home health. These changes take effect May 13, 2025.
Simpler path for very large projects
Projects expected to cost more than $50 million must first get a conceptual development CON. The old trigger was $30 million. Applicants may spend up to $10 million on planning before full review. The prior caps were $1.5 million for non-hospitals and $3 million for hospitals. These rules take effect May 13, 2025.
CON changes start now with transition
The law takes effect May 13, 2025, and applies to projects started on or after that date. If a pending case already has an interested party, the old thresholds and exclusions continue until a final decision. If no one has been granted interested party status, an applicant may withdraw the case under Board rules.
More projects exempt from CON review
Routine swaps of fully depreciated medical gear and common nonmedical fixtures are exempt from CON. Hospitals still include replacements in their budgets. Emergency and nonemergency ground ambulances and related supplies are exempt. Health projects owned by the State or largely State-funded are exempt. The State agency must tell the Board before starting or within 30 days of the contract. These exclusions take effect May 13, 2025.
