Title 10 › Subtitle Subtitle E— - Reserve Components › Part PART III— - PROMOTION AND RETENTION OF OFFICERS ON THE RESERVE ACTIVE-STATUS LIST › Chapter CHAPTER 1409— - CONTINUATION OF OFFICERS ON THE RESERVE ACTIVE-STATUS LIST AND SELECTIVE EARLY REMOVAL › § 14705
The Secretary of the Navy can order early retirement for Navy Reserve officers who are rear admiral (lower half) or rear admiral, and for Marine Corps Reserve officers who are brigadier general or major general, when the Secretary decides it is needed. If the Secretary decides to do this, a selection board must be formed to recommend how many officers to retire. For boards that review rear admirals or major generals, every regular officer on the board must hold a higher rank than those being considered, and at least one board member must be a reserve officer of the same grade. Officers chosen will be separated under the applicable retirement rules.
