The Secretary of the service may let an eligible active-duty member take a leave of absence to go to school under rules the Secretary of Defense makes after talking with the Secretary of Homeland Security. The leave can last up to two years, or up to three years for a health care training program. Enlisted members must sign to extend their enlistment after the schooling by two months for each month of leave. Officers must agree to serve on active duty for two months for each month of leave. A member cannot get a new education leave until any extra service time from a prior education leave is finished. While on leave the member still gets basic pay but not housing or subsistence allowances or other pay. The leave counts toward basic pay increases, retirement eligibility, and time in grade, but it does not count toward completing an enlistment or toward entitlement under 38 U.S.C. 3021. The Secretary can cancel the leave in wartime or a national emergency declared after October 19, 1984, or if the member is not satisfactorily pursuing the education. Eligible member: an active-duty person who qualifies for chapter 30 educational help and who has met the enlistment or officer service requirements.
