If a person has tested positive for HIV and has been told that, they must not knowingly give or sell—or try to give or sell—blood, semen, tissues, organs, or other body fluids for someone else to use, unless it is needed for medical research or testing or done under the Health and Human Services rules in section 377E of the Public Health Service Act. A person can be convicted even if the virus is not passed to anyone. A conviction carries at least a $10,000 fine, at least 1 year and up to 10 years in prison, or both.
