Lets the Secretary of Education waive certain college eligibility rules so more schools can get federal help. The Secretary can waive the rule in section 1058(b)(1)(A) for schools that fit certain situations, such as being heavily state-subsidized with low tuition; serving many low-income students; expanding opportunities for disadvantaged, underrepresented, or minority low-income students; serving rural or isolated areas; being on or near an Indian reservation or large American Indian population; being a tribally controlled college; or, anywhere, if the waiver would meaningfully increase opportunities for Black Americans, Hispanic Americans, Native Americans, Asian Americans, or Pacific Islanders (including Native Hawaiians). The Secretary can also waive the rule in section 1058(b)(1)(B) when convincing evidence shows a school failed that test only because of factors that distorted the result and the school otherwise fits the program’s goals. Every other year the Secretary must report to Congress about schools given eligibility despite not meeting that criterion, naming the distorting factors and listing each school and the reasons. The Secretary may also waive the rule in section 1058(b)(1)(E) for schools on or near reservations if it will help American Indians. Special rules apply for colleges hit by Gulf hurricanes. For any affected institution that was getting help at the time of the disaster, the Secretary must (for fiscal years 2009–2011, and may for 2012–2013) waive certain requirements (including those in 1068(d), 1059(d), 1063, and the funding formula in 1063b(f)(3)), and may change other rules so hurricane effects do not hurt them. The Secretary must give each affected school at least the amount it got in fiscal year 2006, unless total funds are less than 2006 levels, in which case payments are cut proportionally. An “affected institution” is a part A or part B school in an area hit by a Gulf hurricane that shows it had physical damage, sought insurance/FEMA/SBA help, and could not fully reopen or return to pre-hurricane enrollment within the 30 days starting August 29, 2005.
