The federal government gives money to state education offices that have an approved plan. The grant equals the amount the law says the state should get. The state must agree to spend at least 95% of that money on subgrants to local and other eligible groups to run programs for English learners. The state can keep up to 5% for statewide work, like creating uniform entry and exit rules (including assessing possible English learners within 30 days of enrollment), training teachers and principals, planning and coordinating the subgrants, giving technical help to subgrantees, and recognizing successful programs. From that 5% set-aside, up to 50% or $175,000 (whichever is larger) may be used for planning and direct administrative costs. Before states get their shares, the Secretary reserves some money from the yearly appropriation: 0.5% or $5,000,000 (whichever is greater) for certain eligible groups, 0.5% for outlying areas, and 6.5% for national activities (with no more than $2,000,000 for the National Clearinghouse). The rest is split so 80% is given to states based on their share of English learners and 20% based on their share of immigrant children and youth. No state gets less than $500,000. If a state does not have an approved plan, the Secretary will try to let qualified in-state agencies compete for that money and then reallocate any leftovers to other states. Counts of English learners may use American Community Survey data, state English-proficiency assessment counts, or both; immigrant counts use the American Community Survey.
