Organizations that want a grant must apply to the Secretary of Education at the time and in the way the Secretary asks, and must give the information the Secretary requires. The application must describe a full program to meet the language, cultural, and academic needs of Indian children. It must explain how the program will offer culturally related academic activities, follow State, tribal, and local plans and State academic standards, set clear objectives and outcomes, show how grant money will add to (not replace) other funding, list the authorized activities the funds will support, describe needed teacher training, explain how the school will track the progress of all Indian students and share results with the local committee, the community, and the tribes (consistent with the Family Educational Rights and Privacy Act of 1974), respond to earlier assessment findings, and show how the agency worked with tribes in a timely and ongoing way when making the plan. The application must also include written promises that funds will supplement, not supplant, other money; that the agency will report to the Secretary so the program’s effectiveness and cultural relevance can be measured; that the program is based on a local needs assessment and uses local talent (including people from the Indian community); and that it was developed in open consultation with parents, teachers, nearby tribal representatives (within 50 miles), Indian organizations, and when appropriate, students. The program must have been approved in writing by a committee made up mostly of parents and family members of Indian children, plus tribal reps, teachers, and possibly students, with bylaws for how it works. The agency must coordinate with other federal programs, do outreach to parents, use funds only for authorized activities, and have policies (including hiring rules) that ensure parents and community are involved. On request, the Secretary must give technical help to local agencies or Bureau of Indian Education schools for applying, improving program quality and evaluation, and integrating these activities with other school efforts.
