Do not file a Board grievance if, before you file, you already asked another law, regulation, or Executive order (except under title 5, sections 1214 or 1221) to deal with the same issue, and that other process has either been finally decided on the merits or is still pending. If you are not blocked by that rule, you may file with the Board even if the matter could also be handled under chapter 12 of title 5 or another rule or Executive order. Once the Board accepts the case, your choice is final. That rule does not apply to grievances covered by the next paragraph. If your complaint is about a violation listed in section 4131(a)(1)(H), you may either file a grievance here or start, in writing, a proceeding under another law, regulation, or Executive order that can give relief. You will be treated as having made your choice as soon as you timely file either the grievance or the written proceeding.
