The President must review each foreign country’s religious freedom record and, when a government has engaged in or allowed very serious violations, name that country a “country of particular concern” and work to oppose those abuses and promote religious freedom. The President must do this review within 90 days after each Annual Report and can put countries with serious problems but not meeting all criteria on a “Special Watch List.” Reviews must use the Annual Report, Country Reports on Human Rights, and other available evidence. When a country is named a country of particular concern, the President must try to identify the government agencies or officials responsible and tell Congress within 90 days with a signed designation, any responsible parties found, and a summary of actions taken, why, and how well they worked. The President must then take one or more actions (such as sanctions or other measures) within 90 days after required steps are done, or within 180 days if the President certifies one extra 90-day delay for negotiations or to review corrective steps. The President can instead make a binding agreement with the country, may rely on prior U.S. actions already in effect or on broad sanctions if they meet the law’s goals (but must report which sanctions and their effects), and must keep the designation until the President reports it should be removed. A finding of violations does not automatically end other U.S. assistance under other laws.
