The Chairman can fine a tribal game operator or a management contractor up to $25,000 for each violation of this chapter, Commission rules, or tribal gaming rules that the Commission approved. The Commission must make rules that let the operator ask for a hearing and appeal fines. Before taking action that could lead to a fine, closing a game, or changing a management contract, the Commission must give the operator a written complaint in clear language saying what rules were broken. The Chairman can temporarily close a game for a serious violation. Within 30 days after a closure order, the tribe or contractor gets a hearing before the Commission. The Commission must decide within 60 days after that hearing, and at least two members must vote to order a permanent closure. A final Commission decision to approve a fine or a permanent closure can be appealed to the proper Federal district court under chapter 7 of title 5. Tribes may still use their own gaming rules if those rules do not conflict with this chapter or Commission rules.
