Gives plain meanings for words used in the chapter about farm workers and those who hire them. An agricultural association is a nonprofit or cooperative of farmers or ranchers that hires, supplies, or moves migrant or seasonal workers. An agricultural employer is someone who runs a farm, ranch, cannery, packing shed, nursery, seed operation, or similar business and who hires or transports those workers. Agricultural employment means farm work covered by the Fair Labor Standards Act and work that handles or processes crops before storage, like planting, harvesting, drying, packing, freezing, or grading. A day-haul operation is picking up workers, taking them to a job, and returning them the same day. Employ has the meaning used in the Fair Labor Standards Act. Farm labor contracting activity means recruiting, hiring, supplying, or transporting migrant or seasonal workers. A farm labor contractor is a person who does those activities for pay and who is not an employer, association, or their employee. A migrant agricultural worker is someone in temporary farm work who must be away from home overnight, except immediate family of an employer or a temporary H‑2A worker (8 U.S.C. 1101(a)(15)(H)(ii)(a) and 1184(c)). Person means an individual, business, trust, cooperative, association, or corporation. A seasonal agricultural worker is someone in temporary farm work who is not required to be away overnight, including field workers and certain packing or processing workers who use day-haul operations; it excludes migrant workers, immediate family of an employer or contractor, and H‑2A workers (see 8 U.S.C. citations). Secretary means the Secretary of Labor or the Secretary’s representative. State means the 50 states, the District of Columbia, the Virgin Islands, Puerto Rico, and Guam.
