States must set up a State Rehabilitation Council to get federal money for vocational rehabilitation services. The Council is a group that includes people with disabilities, service users, disability advocates, business and labor, service providers, education and workforce officials, and other representatives (for blind services there can be a separate Council with similar members). The Director of the State agency is an ex officio nonvoting member. The Governor (or the State’s chief officer) appoints members after asking for recommendations and trying to include minorities. A majority of members must be people with disabilities who do not work for the State agency (for a blind-only Council, a majority must be blind and not agency employees). Members serve up to 3 years, can generally serve no more than two full consecutive terms, and vacancies are filled the same way as the original appointment. One member is chosen as chair. Members cannot vote on matters that would give them direct financial gain. Councils must meet at least four times a year, hold public meetings and hearings, and can pay members’ reasonable travel, childcare, or lost-wage costs from Council funds (with some funding limits). The Council reviews and advises the State agency about program performance, eligibility rules, services, and employment outcomes. It helps set and review State goals and priorities with the State unit, evaluates the vocational rehabilitation program, and files an annual public report to the Governor and the federal Commissioner. The Council must coordinate with other State councils and independent living centers, prepare a plan for the staff and resources it needs, and may hold hearings and forums to carry out its duties. If the Council and State unit disagree about needed resources, the Governor resolves the dispute.
