Title 38 › Part PART II— - GENERAL BENEFITS › Chapter CHAPTER 15— - PENSION FOR NON-SERVICE-CONNECTED DISABILITY OR DEATH OR FOR SERVICE › Subchapter SUBCHAPTER II— - VETERANS’ PENSIONS › § 1512
Pays a monthly pension to Spanish‑American War veterans who meet certain service rules. Veterans who served 90 days or more during the war, were discharged for a service‑connected disability during the war, or served 90 consecutive days that began or ended during the war get $101.59 a month, or $135.45 if they need regular aid and attendance. A veteran may instead choose the pension rates and conditions from section 1521 of the U.S. Code (except subsection (g)); that choice cannot be changed. For those needing regular aid and attendance, the Secretary must pay whichever is higher: $135.45 or the amount payable under section 1521 as it stood on December 31, 1978. Changes in payment take effect the first day of the month when facts change, with no new application needed. Veterans who do not meet the 90‑day rules but who served 70 days or more (or 70 consecutive days that began or ended during the war) get $67.73 a month, or $88.04 if they need regular aid and attendance.
