Payments for licensing or certification tests named in 38 U.S.C. 3452(b) or 3501(a)(5) are allowed only if the test is already approved under 3672(b)(2)(B) or if the Secretary says the test and the group giving it meet the rules in this law and in chapters 30, 32, 33, 34, and 35, plus any Secretary-made regulations. State approving agencies can approve these tests instead of the Secretary when the Secretary thinks that is practical. A test is approved if it is required by law or rule for a specific job, or if the Secretary finds it is generally accepted by government, business, or industry standards or hiring practices as proving the needed skills or knowledge for that job. Tests given by a State or a local government are automatically approved. Private organizations that want approval must meet several conditions: they must say the test is generally accepted; be licensed or incorporated in a State and have offered this or a similar test for at least two years before applying; use experts for the topics the test covers; have no direct financial stake in test results or in schools that train test takers; keep candidate records for at least three years; give test results quickly and have a process for handling complaints; and give the Secretary required information and details about the test, fees, prerequisites, the certificate or license issued, and renewal rules. The Secretary may ask for extra information to compare the test to the skills or knowledge it claims to measure. For government entities, only the recordkeeping, result notices, information sharing, and test descriptions rules apply. Tests are treated as "courses" and test-givers as "institutions" for certain parts of the law. The Professional Certification and Licensure Advisory Committee was created to advise the Secretary. It had seven expert members, the Secretaries of Labor and Defense as ex officio members, a chairman appointed by the Secretary, and it ended December 31, 2006.
