Summary

The Secretary must send Congress a report by July 1 each year about the fiscal year that just ended. The report must give counts of cases handled by the Department of Labor and by the Secretary of Defense through the National Committee for Employer Support of the Guard and Reserve. It must say how many cases were sent to the Attorney General or the Special Counsel, how many actions the Office of Special Counsel started before the Merit Systems Protection Board, and how many complaints the Attorney General filed. The report must also note cases that involve the same person, say how many involve disability issues or a service-connected disability, describe what each case is about and what stage it is in, list the occupations involved using the Standard Occupational Classification System, point out any patterns of violations with an explanation, and give recommendations for administrative or legislative action, including ways to encourage mediation before claims are filed. Within 30 days after each fiscal quarter ends, the Secretary must send a short quarterly report to Congress, the Secretary of Defense, the Attorney General, and the Special Counsel showing, for the previous quarter, how many cases missed the requirements of section 4322(f) and how many referral requests under section 4323(a)(1) were not made on time. The Attorney General and the Special Counsel must also each send quarterly reports within 30 days about referrals they received but did not handle in the time required under section 4323(a) and section 4324(a), respectively. The Secretary must work with the Secretary of Defense, the Attorney General, and the Special Counsel so the reports use the same categories and so they all have electronic access to the case files, while following the Privacy Act (section 552a of title 5).
