Creates an advisory group called the Advisory Committee on Tribal and Indian Affairs to give advice to the Secretary about Indian tribes, tribal organizations, and Native American veterans. The group must help with, but not replace, government-to-government consultation between the Department and tribes. The Secretary must work with tribes when making the committee’s rules. The committee has 15 voting members chosen by the Secretary from nominees. It must include at least one person from each of the 12 Indian Health Service areas, at least one Native Hawaiian veteran nominated by a Native Hawaiian organization, at least one person from urban Indian organizations, and at least half veterans unless not enough veterans are nominated. No federal employees may serve. Members serve two-year terms, and vacancies must be filled within 180 days. The committee must meet in person at least twice each year, hold monthly conference calls as needed, and may meet virtually during a public health emergency defined in section 20003 of the CARES Act. Federal agency representatives may attend but cannot vote, and the Office of Tribal Government Relations must send a representative to every meeting. The committee can form subcommittees, but they cannot replace the main committee or give direct advice to the Department. The committee’s job is to recommend ways to improve Department programs for Native American veterans, identify issues, suggest solutions, provide a forum for discussion with tribes and organizations, advise on consultation and conferring, encourage work with other agencies and Congress, and highlight Native American veterans’ service. It must send recommendations to the Secretary and the named congressional committees at least once a year; the Secretary must reply in writing within 90 days. The committee must also send a report at least once every two years, and the Department must post the committee’s recommendations, responses, and reports online. Members may get travel pay and per diem at federal rates. Section 14 of the Federal Advisory Committee Act does not apply. Appropriate congressional committees mean the Senate Veterans’ Affairs and Indian Affairs Committees and the House Veterans’ Affairs and Natural Resources Committees. Definitions for terms like “Indian tribe,” “Native Hawaiian organization,” “Native American veteran,” “tribal organization,” and “urban Indian organization” refer to other federal laws.
