Limits how many top Department jobs can be filled by political (noncareer) appointees. No more than 5 percent of the average number of Senior Executive Service (SES) executives from the prior fiscal year may be noncareer appointees at any time in a fiscal year. The average is figured as 25 percent of the sum of the number of SES executives on the last day of each quarter of that prior year. Also, no more than the equivalent of 15 positions may be taken out of regular competitive hiring because they are confidential or set policy. Political party or political activity cannot be used when hiring, assigning, or promoting people in the Department. Two exceptions apply. That rule does not apply to most appointments the President makes under this law (but it does still apply to the Under Secretary for Health, the Under Secretary for Benefits, and the Inspector General). It also does not apply to appointments to SES noncareer jobs or to positions removed from competitive service for confidential or policy reasons.
