Defines what counts as a "Department of Energy defense nuclear facility." It means a production or utilization nuclear site the Department of Energy controls and runs for national security. It does not include facilities covered by Executive Order No. 12344, dated February 1, 1982 (Naval nuclear propulsion); places that move nuclear explosives or nuclear material; facilities that do not do atomic energy defense work; or facilities owned by the United States Enrichment Corporation. It also means a DOE-controlled nuclear waste storage site, except sites developed under the Nuclear Waste Policy Act of 1982 (42 U.S.C. 10101 et seq.) and licensed by the Nuclear Regulatory Commission.
