The Secretary can issue a certificate that insures a loan if an eligible lender applies on the required form and shows the loan meets the rules. The insurance starts when the certificate is issued, unless the Secretary gives an earlier commitment for a proposed loan or a line of credit. In that case, the certificate can be made effective when the lender actually makes the loan or a payment to an eligible student under section 292d(a)(1). Insurance ends if the lender is 60 days late paying required premiums. The lender’s application must include promises to pay those premiums and to send any reports the Secretary requires while the loan is insured. Instead of separate certificates for each loan, the Secretary may give a lender one comprehensive certificate that covers all insurable loans the lender makes between the certificate date and a stated cutoff date, up to a total maximum amount. That coverage can have conditions like reporting rules and premium rules, and the Secretary can confirm specific loans by endorsing the certificate; those confirmations cannot be challenged except for fraud, clear mistakes, or false statements. Rights under a certificate can be assigned only to another eligible lender or the Student Loan Marketing Association. Combining or refinancing insured loans does not cancel the insurance; the Secretary may replace or change certificates to match the new loan. Lenders and borrowers may agree to consolidate or refinance once, but the lender must fully explain the pros and cons. Loans consolidated under section 1078–3 of title 20 are not eligible for special allowance payments under section 1087–1 of title 20.
